Motor Insurers Bureau (MIB) – Does no win no fee apply?

There are cases whereby although a person has been injured the person who is responsible does not have the benefit of insurance. This can occur where a driver who collides with an individual does not have insurance. In these cases the injured person may still be able to recover compensation for his injuries. In 1999 the Motor Insurers Bureau (MIB) was set up to compensate victims of uninsured drivers. In these cases a long as you can trace the person responsible for your accident, you may make a claim. The procedure in these type of cases follows closely the procedure involved in no win no fee cases.

Your solicitor will still ensure that he obtains a medical report to show the extent of your injuries. You will be asked to complete a questionnaire which will go some way to proving that you have tried to obtain compensation from the defendant by making all the relevant checks to ensure that he in fact, does not have insurance. There is a question mark as to whether pursuing your case through this route takes longer as the MIB can be slower than insurance companies.

The MIB offers its own after the event insurance policy. Therefore in all cases the solicitor is still pursuing this matter under a no win no fee scenario.

In ten case where you cannot trace the identity of the driver who has caused you an accident this is government by the Untraced Drivers Agreement. You are still entitled to compensation for death, bodily injury or damage to property, however in these cases only a limited amount of solicitors will take on your case as the fees paid to a solicitor in these cases is not equivalent to normal payment of costs.
